Reasons
Punishment of the crime
1. Defendant A
A. On June 24, 2015, the Defendant: (a) driven a DNA cargo vehicle without obtaining a driver’s license in a section of about 10km from the 55-meter radius in the Hanam-si, Hanam-si to the 3rd-distance road in the Taenam-si, Hanam-si; (b) around 09:36 on the same day, from June 24, 2015.
B. The Defendant in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents is a person who is engaged in driving a DNA cargo vehicle.
On June 24, 2015, the Defendant driving the freight without obtaining a driver's license, as stated in Paragraph 1, at around 09:36, and let the Defendant turn to the left at the right-hand turn from the high-side gate of the sub-committee of the sub-committee of the sub-committee and the sub-committee of the sub-committee of the sub-committee of the sub-committee.
Since there is a left-hand turn at a non-protective point, there was a duty of care to look at whether there is a vehicle that is driven on the vehicle line to the driver of the vehicle and to turn safely.
Nevertheless, the defendant neglected to turn to the left as it is, and caused the front part of the FOccas driven by the victim E (the aged 49) who was driven by the straight line on the right side of the FOccas, which was driven by the victim E (the aged 49).
Ultimately, the Defendant suffered injury to the victim, such as salt, tension, etc. in need of treatment for about two weeks due to occupational negligence as above.
C. As above, the Defendant: (a) intending to conceal the fact of causing a traffic accident while driving the above cargo without obtaining a driver’s license; (b) stated that B, who was on board the cargo vehicle, had caused a traffic accident by driving the said cargo vehicle; and (c) made B a false confession.
Therefore, B makes a false statement to the police officer who cannot know the name called to the site, that he/she was driving the cargo vehicle and caused a traffic accident.
