Defendants shall be punished by a fine of three million won.

In the event that the Defendants did not pay the above fine, only 100,000 won.

Punishment of the crime

Defendant

B is engaged in the sale and service of agricultural machinery in the name of “E” in the remaining Hamp-gun D, and the defendant A is the representative of G farming association which is selected as a subsidized business operator of “F business” from Hamyeong-gun.

On March 201, Hamyeong-gun decided to grant subsidies of KRW 57,500,000 (20% of national expenses, 1.5% of Do expenses, 28.5% of Gun expenses, 30% of Gun expenses, 20% of Gun expenses, 20% of Gun expenses, and 20% of Gun expenses) to G agricultural partnership in order to purchase a total of 4 agricultural machinery, such as 2 Tracter and 2 Tracator.

Unlike the above decision on granting subsidies, the Defendants decided to sell and sell only three agricultural machinery, such as Track 2 and one loading machine, and instead of paying the down payment of KRW 34,50,000 to be paid as Defendant A’s own charges, the Defendants conspired to receive subsidies by pretending that the charges were paid to Defendant B, even though they promised to pay the agricultural machinery used by Defendant A as part of the down payment as the down payment.

On March 10, 2011, the Defendants drafted a sales contract at the above E office, and Defendant B signed a signature to confirm the receipt of the down payment on the said contract in order to pretend that the said down payment was received from Defendant A, even though there was no fact that Defendant B received the down payment of KRW 34.5 million.

On March 29, 2011, the Defendants submitted a written request for subsidies to the Hamyeong-gun, accompanied by a trade agreement to the effect that the said self-paid charges have been executed at the Hamyeong-gun Office located in Pyeongtaek-gun, Nam-gun, and received a total of KRW 57,50,000 ( KRW 23,00,000,000,000, 1725,000,000, 3,2775,000,000) from the Ham-gun on the same day.

As a result, the Defendants conspired to receive the government subsidy of KRW 23 million by illegal means, and acquired the subsidy of KRW 57,50,000 from the victim Hamyeong-gun.
