Reasons
Punishment of the crime
C The representative of “E” in Jeonnam A, who is engaged in agriculture, and F is a person who provides consultation on agricultural-related subsidized projects while operating “G” as a distributor for agricultural machinery, etc., and the Defendant is a person who operates “H (I) of the Company,” a building design and supervision company.
In 2008, the victim Masung-gun selected the "E" as a subsidized project operator, while performing the J project, the total project cost of which is KRW 620,01.6 million ( KRW 165 million for national expenses, KRW 83 million for Do expenses, KRW 248,000 for Gun expenses, KRW 12,41.6 million for Gun expenses, and KRW 100,000 for Gun expenses, and KRW 30,000 for 10,000 for Gun expenses). The C received consultation from F on the above project plan, construction, purchase contract, and subsidy claim.
C.F submitted evidentiary data that the subsidized operator bears 20% of the project cost when purchasing the agricultural machinery subject to the subsidy, to the Agency of the Gisung-gun, the remainder of 80% of the project cost can be paid as the subsidy, and the subsidized operator recruited that the subsidized operator will undertake the project only with the subsidy received from the seller of the machinery and the subsidy received from the Gun office.
The defendant, C, and F are confirmed to have been filed on July 1, 2008 on the above day according to the investigation report (attached documents related to design expenses and M&M in the staff of the Geong-gun Office) around July 1, 2008.
Around August 22, 2008, K, who is a public official in charge, submitted an application for subsidy of KRW 2.26 million and a tax invoice for KRW 1.3 million in the name of the corporation I (representative A) and a deposit certificate for KRW 2.260,000 in the amount of the project cost among the JJ subsidy projects in 2008, which is a total of KRW 11.3 million in the amount of the project cost ( KRW 3.02,000,000,000,000,000,000,000,000,000 won, and KRW 4.52,000,000,000,000).
