[Defendant A] The defendant shall be punished by imprisonment for six months.
However, for one year from the date this judgment becomes final and conclusive, the above sentence shall be executed.
Reasons
Punishment of the crime
1. Defendant A is a de facto representative of a limited partnership company B, an agricultural company (hereinafter “instant company”) that carries on freezing, refrigerating, leasing warehouse, etc. in Seocho-si, Seosan-si.
No person who operates wastewater discharge facilities and prevention facilities in violation of the Water Environment Conservation Act shall discharge water pollutants from discharging facilities without flowing them into prevention facilities.
Nevertheless, around April 25, 2019, the Defendant operated dairy products and food ice manufacturing facilities, which are wastewater discharge facilities, at the place of business of the instant company on April 25, 2019, and discharged water pollutants equivalent to approximately one cubic meter (1,000 L) generated in the course of washing the freezing storage facilities (2 freezing storage facilities) without flowing them into preventive facilities.
B. From June 2019 to July 10, 2019, the Defendant: (a) at the place of business of the instant company; (b) on April 23, 2019, the execution officer D, who belongs to Seosan branch of the Daejeon District Court, entrusted the enforcement of the creditor E; and (c) on April 23, 2019, upon the original copy of the order for payment order No. 2019th 29th 29, the Daejeon District Court: (a) on the part of the obligee E, the Defendant: (a) seized 240 iron bars in the aggregate amounting to KRW 48 million; (b) plastic feed 16,00; and (c) 200 scraped; and (d) the seized article was transferred to the execution officer by means of a public notice in possession; and (d) any person may not dispose of the seized article; and (d) if the seized article is disposed or concealed or damaged, the Defendant may be subject to a punishment for removal from the place of business of G.
In this respect, the defendant shall attach a public official with respect to his duties and indicate other compulsory measures.
