Reasons
Punishment of the crime
On December 27, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Changwon District Court (hereinafter referred to as the “Act on the Control of Narcotics, etc.”) and the said judgment became final and conclusive on April 13, 2013
On January 6, 2012, the Defendant made a false statement to the victim B that “The Defendant would purchase within 1.2 million won of a mountain bicycle for 2 million won of a total of 2 million won.”
However, even if the victim receives money, there is no intention or ability to purchase the mountain bicycle.
As such, the Defendant, by deceiving the victim, received 1,200,000 won from the victim as the purchase price in the same place, and acquired it by deceit.

1. Although anyone who intends to engage in a credit business must register his/her credit business with the competent authority, the Defendant, on September 16, 201, extended a loan of KRW 3 million to D from 201,000 per day to 60,000 to 60,000 won for 60,000 won each day, and operated a credit business without registering with the competent authority until November 24, 2011, as described in the list of crimes in the separate list of crimes.
2. In the event that an unregistered credit service provider grants a loan, the interest exceeding 30% per annum, which is the interest rate set forth in the Interest Limitation Act, cannot be received, notwithstanding the fact that the Defendant, around September 16, 201, lent a loan of KRW 3 million to D on the condition that it shall pay KRW 60,000 per annum 60,000 per annum 60,000,000,000 per annum.
In addition, the Defendant loaned money over five occasions from around that time to November 24, 201, as shown in the attached list of crimes, and received interest exceeding the limited interest rate.
