A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 9, 2010, the Defendant made a false statement to the effect that “The Defendant would make a repayment by dividing KRW 5 million by 260,000,000,000, including interest every month, to the person in charge of direct loan of KRW 5 million,” at the C office located in Pyeongtaek-si B.

However, in fact, the defendant was a bad credit holder at the time, and the debt borrowed from the credit holder was also 30 million won, and there was no intention or ability to repay the loan.

The defendant received 4,97,00 won from the victim as a loan in his/her job.

Accordingly, the defendant was given property by deceiving the victim.

2. On December 9, 2010, the Defendant made a false statement to the effect that “The interest on the loan of KRW 3 million to the victim shall be calculated as 44% per annum, and the principal shall be repaid within five years.”

However, in fact, the defendant was a bad credit holder at the time, and the debt borrowed from the credit holder was also 30 million won, and there was no intention or ability to repay the loan.

The Defendant received 3 million won as a loan from the victim on his job.

Accordingly, the defendant was given property by deceiving the victim.

3. On December 9, 2010, the Defendant made a false statement to the effect that “The Defendant shall pay off the loans of KRW 5 million by dividing 318,000,000, including interest on every month, to a person in charge of loans of KRW 5 million,” at the C office located in Pyeongtaek-si B.

However, in fact, the defendant was a bad credit holder at the time, and the debt borrowed from the credit holder was also 30 million won, and there was no intention or ability to repay the loan.

The defendant received 4,97,00 won from the victim as a loan in his/her job.
