A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The defendant of "2019 Highest 418" invested KRW 70 million by the introduction of the branch in around 2006, but has incurred a debt equivalent to KRW 470 million due to financial fraud, and from that time, he/she borrowed money from the branch in return for the repayment of money from other creditors, and there was no intention or ability to repay the personal debt even if he/she borrowed money from the victims, on July 2018.

1. Around October 2017, the criminal defendant against the victim G made a false statement to the victim’s spouse H by calls from the victim’s spouse H, “I have borrowed money from the victim’s spouse, and I have to pay the money. I have to pay the money. B. If I have borrowed money, I will use and pay it only for a few months.”

However, the Defendant did not have the intent or ability to repay the borrowed money as above.

The Defendant, through H, received two copies of the KRW 10 million check from the victim on October 13, 2017, and two copies of the KRW 16 million check around the 16th day of the same month.

Accordingly, the Defendant deceivings the victim as above and received the delivery of KRW 40 million.

2. Around December 28, 2017, the Defendant against the victim J made a false statement to the victim that “A son calls for a missionary work from a foreign country, and requires money. If a son loans KRW 30 million, interest shall be paid up to two copies, and only two to three months shall be used and returned.”

However, the Defendant did not have the intent or ability to repay the borrowed money as above.

The Defendant received 30 million won from the victim to the K account under the name of the Defendant in the name of the victim as the borrowed money on the same day.

After March 2018, the Defendant called the victim on March 2, 2018 and lent KRW 20 million to the victim.

When lending money, 30 million won is added, and all of them will be repaid until the end of March 2018.
