피고인은 2018. 4. 말경 말레이시아 이하 불상지에서 모바일 메신저 위챗을 통하여, 이른바 ‘ 절도 형 보이스 피 싱 범죄 ’를 저지르고자 계획 중인 성명 불상 자로부터 한국에 가 심부름을 해 주면 한 달 간 8천 링 깃( 한화 218만 원 상당) 을 주겠다는 권유를 받고, 성명 불상 자로부터 받은 항공권을 이용하여 2018. 4. 30. 경 국내에 입국하였다.

통장에 있는 돈이 압수될 수 있으니 전부 인출하고, 현금을 가지고 다니면 신변이 위험할 수 있으니 모텔에 투숙하여 인출한 돈을 모두 객실 냉장고에 두고 모텔 키는 인근 음식점에 맡긴 후 다른 장소로 이동하여 수사관을 만나라. ”라고 거짓말을 하여 이에 속은 피해자로 하여금 현금 316만 원을 수원시 장안구 D에 있는 E 모텔 205호 냉장고에 보관한 후 객실 열쇠를 인근 ‘F’ 식당에 맡기게 하고, 피고인은 같은 날 19:20 경 위챗을 통한 성명 불상자의 지시에 따라 피해 자가 식당에 맡긴 객실 열쇠를 찾은 다음 그 열쇠를 이용하여 위 E 모텔 205호에 들어가 피해자가 그곳 냉장고에 보관하여 둔 피해자 소유의 현금 316만 원이 들어 있는 가방을 가지고 나왔다.
