Punishment of the crime

1. No person who violates the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials) shall distribute, provide, openly exhibit or screen obscene materials for children or juveniles;

On May 5, 2017, the Defendant, at the Defendant’s residence located in Eunpyeong-gu Seoul Metropolitan Government apartment C, 102-dong 807, connected by the “E” account to D, an Internet web site, and made it possible for the visitors of the above site to view “G” compressed files containing three sexual intercourse files, which are expressed as “mars”, “F”, “F”, “V female students”, “child students”, and “childs” as their titles.

Accordingly, the Defendant distributed, provided, or openly displayed obscene materials for children and juveniles.

2. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, etc. (Distribution of obscenity) shall distribute information with an obscene content distributed, sold, rented, or displayed openly in the form of code, text, sound, image, or motion picture through an information and communications network;

On August 14, 2017, at the place indicated in paragraph (1) at around August 14, 2017, the Defendant opened a cartoon file with a cartoon file with the content that sexual intercourses between the young female and the adult male with sexual intercourses with sexual origin, from which the age cannot be known as “ adults” on the cartoon bulletin board, “H”, and “H” as stated in the same paragraph, and made it possible to view the cartoon files as indicated in the attached list of crimes, from July 23, 2016 to August 18, 2017.
