1. Of the judgment of the court of first instance, the part against the Plaintiff corresponding to the following additional payment order shall be revoked.

1. The parties' assertion

A. The Plaintiff: (a) around December 2012 and January 9, 2013, as indicated in the following list of supply; (b) supplied a ventilator to the Defendant on or around January 17, 2014; and (c) the Defendant is obligated to pay the Plaintiff the total amount of KRW 5,589,000 as the price for the goods.

The plaintiff is seeking the payment of KRW 3,956,00 to the defendant.

B. The Plaintiff established 80 ventilation windows to the Defendant, and the price was 960,000 won (=80 x 12,000 won per dog (including installation price). Moreover, the Plaintiff supplied 343,00 won without installing 49 ventilation windows (=49 x 7,000 won per dog). Thus, the Defendant is obligated to pay the Plaintiff the price of KRW 1,303,00 (=960,000).

2. Determination

A. The following facts can be acknowledged according to the overall purport of Gap evidence Nos. 1, 2, 5, and 7 and the purport of the whole pleadings.

1) The transaction account books submitted by the Plaintiff (Evidence A Nos. 1, 2, 5, 7, hereinafter “instant transaction account books”).
