A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. The Defendant, who was in a de facto marital relationship with C, asked C to lend KRW 100 million to D on June 15, 2007.
However, the Defendant thought that KRW 20,000 of the above KRW 100,000 won was transferred to the E account, and C demanded a loan certificate of KRW 100,000,000 to forge the certificate of borrowing in the name of the State.
On November 15, 2010, the Defendant borrowed the above money by using a computer at an irregular site on or around November 15, 2010, the amount of money : 50,000,000,000,000 per annum. The interest shall be determined by 10% per month. The amount of the principal shall be expressed as the 17th day of November 2012. The clerk shall be deemed as the 15th day of November 2010, the name and address of the debtor: D, F, address: H (I): name, name and resident registration number: K, resident registration number: K and C; and (B) D’s representative director, H, D, H, H, and J’s name and without the permission of J; and (B) D’s name and duties, personal seal, and seal for the purpose of exercising the rights and duties of H, (D) name and duties, and seal under the name of D’s former name and duties.
B. On November 15, 2010, the Defendant: (a) borrowed the foregoing money by using a computer on a closed-end basis on a date on which he/she borrowed the money: 10% per month; (b) on November 17, 2012, the principal amount shall be set at 10% per month; (c) on November 15, 2010, the name and address of the obligor: (d) the business registration number: (i) the name and address of the obligor: H (I); (iv) the name, name and resident registration number: H (I); (iv) the name and resident registration number; (iv) the name and resident registration number; and (iv) the creditor; and (iv) the name and resident registration number of the Chungcheongnam-gun’s representative director, H, D (State), H and H’s name and without the permission of J; and (iv) the owner’s prior custody of the certificate of borrowing; and (iv) the owner’s rights and obligations and seal under the name of J;
C. On February 14, 2012, the Defendant was the N office located in Seo-gu M in Seo-gu, Seoan-gu, Seocheon-si.
