The defendant is not guilty, and the summary of the judgment of innocence is publicly notified.

1. The summary of the facts charged in the instant case is a person who has served as a representative director of D (ju) located in Seo-gu, Seoan-gu, Seoan-gu, Incheon.

1. On May 8, 2012, the Defendant was expected to receive a contract from Aptian (State) in the D office in the operation of the Defendant located in Dong-gu, Nam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Seoul, for a period of May 8, 2012.

The purport was that the contract deposit amount of KRW 30 million shall be paid to the effect that it may be entrusted with civil engineering works during the creation work.

However, in fact, it is not clear that the Defendant entered into a “written intent to participate in the construction work” with Art (State) and the “written intent to re-subcontract the civil construction work even if the Defendant received the contract deposit from the injured party, and it is not clear that the contract for the construction work was entered into with Art (State) and the prime contractor of the said construction work.

Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) wired the victim’s money to the Agricultural Cooperative Account (Account Number H) in the name of the Defendant on May 9, 2012; (c) KRW 27 million on May 10, 2012; and (d) KRW 30 million in total from the victim.

2. On February 8, 2013, the Defendant said, at the above office around February 8, 2013, the victim F, “If the Defendant pays KRW 30 million as contract deposit, he/she will subcontract the transport right to the said transport right.”

In fact, however, there was no intention or ability to subcontract the mining right even if the defendant received the contract deposit from the injured party, because there is no permit for mining from the Si/Gun/Gu office and it is unclear whether the court (State) which ordered the defendant to transport the mining right.

Nevertheless, the defendant deceivings the victim and belongs to it.
