Defendant

A Imprisonment of three years and six months, and Defendant B shall be punished by imprisonment of one year.

However, this judgment is delivered against Defendant B.

Punishment of the crime

[2016 Highest 138] Defendant A was sentenced to five years of imprisonment by the Incheon District Court for a violation of the Act on the Control of Narcotics, Etc. on February 4, 2010, and completed the execution of the sentence on July 2, 2014.

Even if the Defendants were not the narcotics handler, they dealt with the Metropha (one philophone, hereinafter referred to as the “philophone”) which is a local mental medicine as follows.

1. Defendant A

A. On August 2015, the Defendant received approximately 0.1g of the penphone, which was packed in the paper from F, in the vicinity of the Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and received from F, a penphone without compensation.

B. On December 23, 2015, the Defendant administered philophones by inserting approximately 0.07 gopphones into a single-use injection machine, dilution with bio-vescopon into the Defendant’s arms blood cells at H’s house located in Nam-gu Incheon Metropolitan City G Housing No. 303.

On December 24, 2015, the Defendant: around 14:10, the Defendant placed approximately 3.34 grams of philophones contained in the plastic rophones in the G 2nd floor in the Dong-gu Incheon Metropolitan City, and the Defendant was operated by the Defendant who parked in the said J parking lot.

SM5 Handphones containing approximately 34.17g of philophones contained in metal rinks at the vehicle's seat storage space, carrying a total of 37.51g of philophones.

2. Defendant B

A. On July 2015, the Defendant received philophones without compensation by finding about 0.1g of philophones concealed in the fence at the location of F, which was located in Jung-gu Seoul, Jung-gu, Seoul, with a view to searching for approximately 0.1g of philophones at the wall.

B. On July 2015, the Defendant administered philophones by inserting approximately 0.02 gramphones into a single-use injection machine, dilution with tap water, and injection into the Defendant’s arms bloodline.

On September 2015, the Defendant received philopon free of charge by finding out about 0.1g of philopon, which was hidden at the wall, from a police officer near the above L, and by finding out about 0.1g of philopon at the wall.

[2016 Highest 1113] Defendant A shall handle narcotics.
