A defendant shall be punished by imprisonment for seven years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

The Defendant, by taking advantage of the circumstances in which the victim C(M, 17 years old) was living together with the Defendant’s children and was pregnant, but the said children were unable to believe that the victim’s pregnant baby was her own child, and that the victim’s intellectual disability was not easily refused another person’s demand, and that the victim’s demand was an indecent act or sexual intercourse.

1. The Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Acts by Persons with Disabilities), ought to do so at the victim’s own residence located in D at the time of the new wall time between October and November, 2015 at intervals of about 5-10 times, and to do so at the victim’s place of residence in a different room from himself/herself.
