A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On May 4, 2016, the Defendant was sentenced to 10 months of imprisonment due to fraud, etc. in support of the Sungnam branch of the Red Prison, and was released on October 28, 2016 during the execution of the above sentence on November 9, 2016, and the parole period was expired on November 9, 2016.

1. On November 6, 2016, the Defendant: (a) obtained a copy of “D” personal bank card in the name of the victim E in the vicinity of “D” located in Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, Sungnam-gu; (b) obtained one copy of the victim’s personal bank card in the name of the victim E; and (c) did not take necessary procedures, such as returning it to the victim.

Accordingly, the defendant embezzleds articles that have been separated from the possession of the victim.

2. Violation of Acts in financial business specializing in fraud and credit finance;

A. On November 6, 2016, the Defendant, at around 06:34, took the same amount of monetary benefits by paying 1,250 won for the e-mail card in the name of E acquired, such as paragraph (1), using the subway at the mother station located in Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, Sungnam-si, and by inducing another person to use the e-mail card lost by paying 1,250 won for the e-mail card, and by inducing the construction of the e-mail to pay 1,250 won for the e-mail.

B. On November 6, 2016, the Defendant, at around 07:50, was using a bus at Sungnam-dong, Sungnam-gu, Sungnam-gu, Sungnam-si, and was using a bus in one e-mail card in the name of E, which was acquired as prescribed in paragraph (1), to pay the bus fare of KRW 2,500, which was lost by another party, and was exempted from paying the bus fee of KRW 2,500 by deceiving the bus company between the victims.

On November 6, 2016, the Defendant purchased goods equivalent to the sum of 5,250 won, such as Chinese tobacco, at H convenience stores operated by the victim G in Seongbuk-gu, Sungnam-si, Sungnam-si, with a total of 5,250 won, and paid 5,250 won to employees of the above convenience stores by presenting one copy of the physical card in the name of E acquired, such as paragraph 1, as his/her card, by paying 5,250 won to others.
