[Criminal Power] On November 21, 2019, the Defendant was sentenced to three years of imprisonment for fraud, etc. at the Busan District Court, which became final and conclusive on December 13, 2019.

1. No person who violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. shall be knowingly provided with personal information for profit or fraudulent purposes;

The Defendant purchased another person’s “B” account to use the Internet goods fraud crime. On August 15, 2018, the Defendant: (a) contacted B account seller (AD: C) on the name omitted from the Internet search to pay KRW 3,000 per each account; and (b) knew of the fact that personal information was leaked at around 14:09 on the same day, the Defendant provided B account information (i.e., F: number: G, e-mail: H: I) and B account information (i.e., H and telephone number: H: N: L, e-mail: N) and B account information (i.e., e-mail: : L and e-mail: N) on the same day from August 21, 2018 to August 21, 2018.

As a result, the Defendant knowingly received personal information for an unlawful purpose.

2. No one who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Violation of Information and Communications Network, etc.) shall intrude on any information network.

On August 15, 2018, the Defendant entered “E”’s account information in order to prevent the commission of Internet goods from committing a crime, using the “E” account secured in the same background as that of paragraph (1) above, and accessed B’s website. From around that time to August 21, 2018, the Defendant accessed B’s website into the information and communications network without access authority.
