1. The Plaintiff:

A. Defendant B shall display the attached drawings of 51,52,53,54,51 among the 4,445§³ of Gangnam-gu Seoul Metropolitan Government D forest land.

1. Basic facts

A. On March 18, 2013, the Plaintiff completed the registration of ownership transfer on the ground of a donation made on March 4, 2013 with respect to 4,445 square meters of Seoul Gangnam-gu D Forest (hereinafter “instant land”).

나. 피고들은 이 사건 토지 중 별지 도면 표시 51, 52, 53, 54, 51의 각 점을 차례로 연결한 선내 ㉳ 부분 지상에 건립된 화장실(조립식 판넬) 4㎡와 같은 도면 표시 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 31, 32의 각 점을 차례로 연결한 선내 ㉴ 부분 지상에 건립된 주택(조립식 판넬) 105㎡와 같은 도면 표시 44, 41, 42, 43, 44의 각 점을 차례로 연결한 선내 ㉵ 부분 지상에 건립된 창고(함석) 16㎡(이하 위 바, 사, 아 부분 지상 건물을 통틀어 ‘이 사건 건물’이라 한다)을 소유하면서 점유하고 있다.

2. Determination

A. According to the above facts of recognition, Defendant B, the owner of the instant land, removed the instant building, and the Defendants are obligated to deliver the instant building site to the Plaintiff.

In addition, according to the Plaintiff’s claim, Defendant B, while occupying and using the instant building, obtained profits from the use of the instant building site and thereby inflicted damages equivalent to the same amount on the Plaintiff. As such, Defendant B is obligated to return unjust enrichment equivalent to the land use profit in the said site to the Plaintiff.

B. As to this, the Defendants asserted that the superficies for the instant building were the Defendants, but there is no evidence to acknowledge the establishment of the agreed superficies, since they used the said temporary building with the consent of F, the former owner of the instant land, around 1983 when the Defendants had constructed and used the temporary building on the instant land in around 1976.
