Reasons
Punishment of the crime
1. Defendant A’s sole crime committed by Defendant A, as the head of the SK TelecomF in Dobong-gu Seoul Metropolitan Government from April 2016 to January 2017, Defendant A, while operating the said agency, was willing to arbitrarily open the cell phone in the name of the customers visiting the said agency and sell the said cell phone to the purchaser of the relevant mobile phone.
A. On August 10, 2016, the Defendant: (a) from the foregoing SK Telecom F, he/she held a copy of his/her identification card of G (Korean nationality) that opened his/her mobile phone through the foregoing agency; (b) connected the SK Telecom application program using the string PC in the foregoing agency; (c) arbitrarily entered the personal information of G necessary for opening the cell phone; (d) arbitrarily entered the personal information of G necessary for opening the cell phone; and (e) sent the electronic file to the said SK Telecom employee, which is aware of the fact, as the said electronic file was duly completed.
Accordingly, the Defendant entered and exercised a copy of the application for joining a mobile phone in the name of G, an electronic records related to rights and duties, for the purpose of hindering the management of affairs.
In addition, from August 10, 2016 to January 11, 2017, the Defendant drafted an application for joining a mobile phone which is an electronic records of the company ten times in total, as shown in Appendix I, and exercised it ten times in total.
B. On August 10, 2016, the Defendant sent an electronic file of an application for the purchase of a mobile phone in the name of G at the above agency, as set forth in subparagraph 1(a), to the employee in charge of the victim SK Telecom (ju), as if G was written, and changed the phone of the phone of 1,130,800 won at the market price into G.
As above, the Defendant: (a) deceiving the victim as above; (b) received from the victim the 6 flusular phone from the victim; and (c) issued one flusular phone from August 10, 2016 to January 11, 2017.
