All appeals filed by the prosecutor against the Defendants are dismissed.

A. According to the above evaluation criteria, (b) the actual flight time as a result of the actual flight test using AM for the Army under the conditions set out in the above evaluation criteria: (c) the actual flight time shall be one hour and 55 minutes; (d) the weight of 5,885km (in four persons); (e) the fuel quantity of 778km (in auxiliary fuel tank not installed) * the content that the average fuel consumption rate is 4.76km/mination; (d) the average fuel consumption rate of 4.76km/mination; and (e) the maximum physical use time, including the fuel residues and auxiliary fuel tank fuel quantity as a result of the test for actual expenses to run, was calculated at 3 hours and 14 minutes; and (b) the prosecutor stated that the results of the test “performance” (Evidence 5:759 of evidence record). ② The prosecutor does not confirm whether the performance was normally satisfied even if it was submitted from AL company.

The argument is asserted.

The “data evaluation method and procedure” column of “data evaluation” column of “data evaluation” as a result of each test and evaluation indicated in the “data evaluation method and procedure” column as follows: “In the event that equipment for performing operations is installed, for a maximum period of two hours and 40 minutes and more, for a maximum period of 2 hours and 40 minutes and more, * large/large-scale equipment for performing operations: Drheata (soar), electronic electric power failure equipment, electric external detection equipment, and RADR: Provided, however, it is clear that the above indication does not constitute the evaluation criteria. Unless there is an indication that it is required to determine whether the instant test and evaluation plan meets the standards for establishment, it is difficult to view that the instant test and evaluation plan falls under the evaluation criteria for establishment, and thus, it appears to have dealt with the nature of the evaluation of the relevant item, but it appears to have been conducted for the purpose of obtaining additional data, and thus, it appears to have been conducted for the purpose of “data evaluation and evaluation” as a result of AAD test evaluation.
