Punishment of the crime
【Criminal Power】 On September 12, 2013, the Defendant was sentenced to one year and two months of imprisonment for fraud, etc. at the Jung-gu District Court, and completed the execution of the sentence on June 5, 2014.
【Criminal Facts】 2014 Highest 2349】
1. On July 6, 2014, around 13:08, the Defendant made a false statement to the effect that “The Defendant would return to the orchard by getting on a D personal taxi operated by the victim C in front of the 239 Incheon Police Station, Seocheon-ro, Gyeonggi-do, Gyeonggi-do, 2014, as if he would pay the victim’s taxi expenses.”
However, the defendant did not have any intention or ability to pay taxi expenses because he did not have cash or credit card at all.
As above, the Defendant: (a) by deceiving the victim; (b) caused the victim to drive approximately KRW 120 km up to the front of the “F cafeteria” in Gyeonggi average E; and (c) did not pay KRW 157,000, thereby acquiring financial benefits equivalent to the same amount.
2. At around 17:00 on the same day as described in paragraph 1, the Defendant ordered food as if he would pay the food value and the oil fare in the “F cafeteria” operated by the victim G in Pyeongtaek-gun of Gyeonggi-gun, and issued a false order stating that “I am, I am, I am, I am, and I am am on the South Island.”
However, the defendant did not have any intention or ability to pay the food value or the fare because he did not have cash or credit card at all.
As above, the Defendant, by deceiving the victim, was provided with food such as rocketing sugar and beer by the victim, was potable, and had the victim operate approximately 4 km in the twit, and did not pay food value of KRW 87,000 at the market price and KRW 50,000 at the twit rental fee, thereby acquiring property benefits equivalent to the same amount.
The Defendant, at around 07:49 on July 6, 2014, 201, is boarding a private taxi operated by the victim J on the front side of the “I” located in Macheon-si.
