1. The defendant is based on the sale on April 6, 2004 with respect to each real estate listed in the separate sheet to the plaintiff.
Reasons
1. Facts of recognition;
A. On May 23, 2003, the Defendant’s child C and D representing the Defendant, drafted a real estate sales contract (hereinafter “the instant sales contract”) stating that “The Defendant sells approximately KRW 300,00 in 20,000 (in the case of a contract, KRW 50,000,000,000,000 shall be paid at the time of the contract, and KRW 150,000,000,000,000,000,000,000,000) out of Gyeonggi-gun E and F orchard to D” (hereinafter “instant 1 sales contract”).
B. Around May 2003, the Defendant prepared a letter of commitment to payment of donation and a letter of consent to land use stating that “The Defendant shall accept the Plaintiff to use 746 square meters out of 2,959 square meters in Gyeonggi-gun E, and 4,546 square meters in a site incorporated into an urban planning road according to the permission to change the form and quality of 439 square meters among 2,546 square meters in F.M. 2,96 square meters in Gyeonggi-gun E, Yangyang-gun, E, and 746 square meters in a 2,959 square meters in a 7,546 square meters in a 4,546 square meters in a private road.”
C. The Defendant’s spouse G on August 11, 2003, representing the Defendant, promised on the Plaintiff to receive KRW 10 million on behalf of the Defendant as an intermediate payment out of the purchase price F and E (Apppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppp
On November 17, 2003, “A receipt of the instant case” (hereinafter “the receipt”). D. On November 17, 2003, the Defendant drafted a receipt stating “A recipient: H, daily gold 130 million won: E, F (1,185 square meters), and the Defendant: (a) on April 6, 2004, the Defendant sold to H a KRW 200,000,000,000,000,000 won: (b) E, F (1,185 square meters); and (c) on April 6, 2004, the Defendant sold to H the amount of KRW 746 square meters of Gyeonggi-gun E, G, and 456 square meters of KRW 4,546 square meters of KRW 20,000.20,000.
