Punishment of the crime

1. Defendant A is a director of the company B under construction with a subcontract for remodeling work for E-factory in Sistitu City D from C to Sistitu City, who has overall control over the safety and health affairs of his employees.

Around 08:00 on June 9, 2015, the Defendant: (a) received a request from F operating the said C Company to move a panel in the existing factory of the E Company located in the vicinity of the said construction site to another place; and (b) instructed G to contact G with employees who were employed in the said remodeling site, and to dissolve the panel in the existing factory of the E Company H and D-1, the E Company located in the said remodeling site.

In the course of dismantling a building, etc., a defendant shall conduct a prior investigation into the relevant work, the topography, ground, and ground level, etc. in the relevant place of work and record and keep the results thereof in order to prevent any danger to workers, and shall prepare a work plan in consideration of the results of the investigation, and have him/her conduct work in accordance with the relevant plan, and where the work is likely to cause danger to workers in the course of falling or falling, etc., he/she shall install the work plan by means of assembling the vision, etc., and where it is difficult to install the work plan, he/she shall install a safety protective net in compliance with the standards, and where it is difficult to install the safety protective net, he/she shall take measures necessary to prevent any fall, such as having workers wear the safety belt, and have workers wear the safety cap at a place at a risk of falling at least two meters in height.
