1. From August 26, 2014 to the Plaintiff, the Defendant lost the Plaintiff’s ownership as to the 2,196 square meters of land in Namyang-si, Namyang-si.

1. Facts of recognition;

A. Ownership relation 1) D and E with respect to the instant land: (a) on July 29, 1982, Namyang-si, Namyang-si, Seoul, before subdivision, 2,341 square meters (hereinafter “instant land before subdivision”).

D acquired the ownership of the land of this case from E on November 7, 1988 and became a sole owner of the land of this case before subdivision. 2) The ownership of the land of this case was transferred from D on August 24, 1995 to F on June 28, 1996 to F, and from F on February 19, 204 to G in sequence.

3) On March 4, 2004, the instant land prior to the division is 2,196 square meters prior to C in Nam-si, Namyang-si (hereinafter “instant land”).

(4) The ownership of the instant land was transferred to I and J on August 15, 201 due to the inheritance by consultation and division, and was transferred to the Plaintiff on August 26, 2014 due to the sale by discretionary auction on August 26, 2014.

나. 이 사건 건물에 관한 소유관계 1) D과 E은 1989. 1. 27. 이 사건 토지 지상 별지 지적개황도 표시 ㉠ 부분 시멘트블록조 스레트지붕 단층 건물 126.71㎡, 같은 도면 표시 ㉡ 부분 시멘트블록조 스레트지붕 단층 건물 24.24㎡, 같은 도면 표시 ㉣ 부분 시멘트블록조 스레트지붕 단층 건물 137.74㎡, 같은 도면 표시 ㉥ 부분 시멘트블록조 스레트지붕 단층 건물 98.77㎡, 같은 도면 표시 ㉧ 부분 시멘트블록조 스레트지붕 단층 건물 99.14㎡(이하 위 ㉠, ㉡, ㉣, ㉥, ㉧ 부분 건물을 ‘이 사건 건물’이라 한다

D) On the same day, D acquired E’s co-ownership shares on the instant building from E and became a sole owner of the said building. (ii) On January 16, 2004, D transferred its ownership to the Defendant.

C. The monthly rent of the instant land from August 26, 2014 to August 25, 2015 is KRW 4,332,00, and the annual rent is KRW 51,984,00,00.
