Defendant shall be punished by a fine of KRW 3,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who operates a facility for discharging excreta in the name of "C" in Pyeongtaek-si B and 3 lots.

1. A person who has obtained permission to install facilities for discharging foul waste in violation of the Act on the Management and Use of Excreta shall not commit an act of discharging or threatening to discharges livestock, manure, or liquid manure into a public waters, or discharge livestock excreta without flowing it into a treatment facility;

Nevertheless, on February 1, 1997, the Defendant: (a) from around November 201, when he/she obtained permission from an administrative agency to install and operate discharge facilities for livestock excreta; (b) from around March 1, 2015, he/she stored livestock excreta generated from the discharge facilities for livestock excreta by creating a pool of about 1m in depth and about 10m in width on farmland adjacent to the farm; (c) let livestock of a quantity not known around November 2017 flow into the adjacent drainage route; and (d) let livestock flow into the public water area; and (e) from November 24, 2017 to December 27, 2017, he/she discharged livestock of a quantity that cannot be mixed with snow to flow into the public water area; and (e) he/she stored livestock of a quantity that flow into the adjacent drainage route of livestock excreta into the public water area; and (e) he/she stored livestock of a quantity that can be found to flow into the farmland into the adjacent drainage route.

2. A person who runs livestock farming business in violation of the Livestock Industry Act shall obtain permission from the competent administrative agency by preparing matters concerning the appropriate number of livestock raising facilities, equipment, and unit area, and shall also obtain permission for change in the same manner as the person intends to increase the area of livestock raising facilities by at least 10/100;

Nevertheless, while the Defendant obtained a permit to engage in livestock farming business on June 3, 2005 with a scale of 1,585 square meters, the total area of the livestock breeding facilities is approximately 1,819 square meters by expanding the livestock breeding facilities of approximately 472 square meters in around November 15, 2017.
