1. The defendant shall be punished by imprisonment for eight months;

Punishment of the crime

The defendant is a person who is engaged in driving a car in a SP area.

On November 20, 2014, the Defendant, around 23:27, proceeded to the intersection of “E” private distance from the north-gu, Gwangju, to the third apartment from the direction of the Yongsan-gu, Yongsan-gu.

At the time, at night and in such cases, a person engaged in the driving of a motor vehicle has a duty of care to temporarily stop in front of the intersection or slowly drive the motor vehicle in front of the intersection. When there are other motor vehicles already entering the intersection, there was a duty of care to safely drive the motor vehicle by yielding the course of the vehicle.

Nevertheless, as long as the Defendant neglected to do so and did not temporarily stop or slowly in front of the said intersection, the Defendant got off the said intersection prior to the said car and was driven by the victim F.F. The Defendant, by negligence in the course of performing the above duties, sustained injury to the sculatory dump, etc., which requires treatment of the victim for about two weeks, and at the same time, escaped without any necessary measures, such as stopping the said dump,121,731 won, while destroying the said dump to repair costs.
