A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

On July 21, 2014, the Defendant was issued a summary order of KRW 5 million for a fine for a violation of the Road Traffic Act in the Seo-gu District Court’s Seo-Support on July 21, 2014; KRW 2 million for the same crime in the same court on February 17, 2014; and KRW 1 million for the same crime in the same court on April 20, 2009, respectively.

The defendant has been punished for the violation of the Road Traffic Act at least twice, and is a person who is engaged in driving of B Lone Star or passenger cars.

On May 29, 2015, the Defendant: (a) around 20:40, while under the influence of alcohol with a blood alcohol concentration of 0.115% 0.15%; (b) transferred the front road D in Daegu City and Seo-gu C, Daegu City without a driver’s license to the side of the merchants’ four streets from the border market.
