A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On March 25, 2008, the Defendant was sentenced to a fine of KRW 1.5 million for a violation of the Road Traffic Act (driving) at the Daejeon District Court on March 25, 2008, and on June 3, 2013, the same court was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act (driving).

On June 2, 2016, at around 07:50, the Defendant driven a three-way motor vehicle under the influence of alcohol content of at least 0.112% while under the influence of alcohol without obtaining a driver’s license at approximately 13 km section from the Do in front of the Daejeon Seo-dong, Daejeon Seo-gu, Daejeon to the direction of 6.8 km in the mountain of Daejeon Nam-gu.

Therefore, although the defendant had a record of driving under the influence of alcohol more than twice, he again driven the car without a license while under the influence of alcohol.

On July 1, 2016, at around 05:25, the Defendant, without a driver’s license, driven a Csan-type car in the section of about 2 km from the lived road near Daejeon Seo-gu, Seosan-gu, Daejeon to the error-dong of 0.136% of the blood alcohol concentration.

Therefore, although the defendant had a record of driving under the influence of alcohol more than twice, he again driven the car without a license while under the influence of alcohol.
