The Defendant posted an article that criticizes the victim C's criticism on the Internet BanB, around June 9, 2018, the Defendant conspiredd with D to post an article on the victim's BanB that D sent to the Defendant by setting up against this around D on the same day.

이에 따라 피고인은 D으로부터 게시할 글의 내용을 전송받아 같은 날 위 밴드에 ‘(전략) C 당신은 나를 잘 기억 못하겠지만 난 당신을 너무 잘 알아요. 내가 회사 입사하니 사람들이 C하고 친하게 지내지 말라 하더군요. 왜 그러냐니 친해지면 돈 빌려달라하니 조심하라더군요. 그리고 저 여자 알콜중독자인데 술 처먹으면 미친ㅇ가 되어 아무나 주워 패고 새벽에 전화해서 쌍욕하고 ~~~ 얼마나 힘이 쎈지 남자도 개 패듯이 막 주워 팬다고 가까이 하지 말라더군요. 그래서 당신을 멀리했기 때문에 당신은 날 잘 모를거요. (중략) 그리고 당신은 자기돈으로 투자 안 했잖아요. 주변사람들한테 소개해서 수수료 받은 걸로 딸 이름으로 사 놓은거잖아요. 자기돈 한 푼도 안 넣었으면서 회사에 10억 투자해서 회사 지분 갖고 있다고 재벌행사하며 사기치고 다니며 땅사라고 꼬셨잖아 그것도 땅 팔 때마다 수당 더 달라고 D 달달 볶아서 우리보다 수당 더 많이 뺏어내어 투자한거잖아요(후략)’라는 글을 게시하였다.
