A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall obtain money from B, who is an applicant for compensation, 228,00 won, and C, who is an applicant for compensation.

Punishment of the crime

On March 10, 2020, the Defendant stated that “Around March 10, 2020, the Defendant would send a game money to the victim J who reported the fact that he/she would deposit the money,” by accessing an online game “K” to a cell room in Michuhol-gu Incheon, and by posting a text of sales of the game money.”

However, even if the defendant received money from the victim, he did not intend to send the game money.

The Defendant, as shown in the attached Table 1, by deceiving the victim and receiving KRW 774,00 from the victim’s M account (N) on the same day, received the total sum of KRW 2,968,600 from 13 victims from March 29, 2020.

Around March 9, 2020, the Defendant sent a false statement to the Internet Game K, “To sell the Game money,” and reported this to the victim O who sent a false statement to “to pay the money if to pay the money.”

However, in fact, the defendant only planned to use the above money for living expenses and did not have the intent or ability to pay the L which is promised even if he received the money from the victim.

The Defendant, as above, by deceiving the victim as above, received KRW 182,400 from the victim’s account (P) around 15:03 on the same day from the victim, and from that time, received KRW 10,691,70 in total from 55 victims, as described in the Attached Table 2, from March 28, 2020 by the following method from March 20:31, 200.

Accordingly, the defendant acquired the victims' property by deceit.

around March 9, 2020, the Defendant posted a letter of sales of game money at the mutual incompeties located in Michuhol-gu Incheon, and at the reading room of online game “K” and reported it to the victim Q Q who contacted with it.
