A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the sentence shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highly 731"

1. On January 2015, the Defendant: (a) at the Defendant’s house located in the territory of Sinwon-si, Suwon-si, Suwon-si; (b) on the same day, the Defendant left the victim D (one year old, 11) who is a relative of the Defendant and the Defendant’s son; and (c) demanded the victim to her to her kis; (d) while demanding the victim to her kis; (b) the victim refused to refuse to do so; (c) the victim was her kis around the bed; (d) the victim was placed in the bed by the bed; (d) the victim was unable to move the victim’s body with the victim’s own arms and legs; and (e) the Defendant was her chest to put the victim’s chest into the bed, put the victim’s her body back to the bed; and (e) she forced the victim to put the victim’s her body out of the body by force into the bed’s clothes.

Accordingly, the defendant committed an indecent act by force against the victim who is a relative of relatives.

2. On January 27, 2019, the Defendant was subject to a victim protective order issued by the Suwon Family Court on April 3, 2019, stating that “No access within 100 meters from the victim’s residence or workplace shall be allowed until October 2, 2019, and no access shall be transmitted by wire, wireless, optical, sound, or other electronic means using the victim’s handphone or e-mail address; the Defendant ordered not to transmit codes, text, sound, or images by means of wire, wireless, optical, or other electronic devices; and on September 25, 2019, the Defendant extended the period from the above court to December 2, 2019.”

‘A victim protective order was decided to extend the content of the order.

Nevertheless, the Defendant, from November 25, 2019 to around 18:06 of the same day, posted five telephone calls to the victim at a place where it is impossible to know the location between the victim and the victim from around 17:26 on the same day, and around 18:09 on the same day.
