Punishment of the crime

The Defendant, along with C, proposed that the pseudo petroleum products mixed with light oil will be sold to the customers of the gas station by pretending the completion of the work of mixing them with light oil at the gas station located in Gu and Si, and C is in charge of the management and general direction of the funds of the gas station as above, and the Defendant manages the gas station according to C’s instructions, and if it is controlled, the Defendant would be punished. In return, the Defendant would receive two million won and 300 million won if he is punished instead.

1. No person who violates the Petroleum and Petroleum Substitute Fuel Business Act shall manufacture, import, store, transport, keep, or sell fake petroleum products, and keep them with the intention of selling even though he/she is a pseudo petroleum product;

At around 22:00 on August 5, 2014, the Defendant, in collusion with the foregoing C, sold pseudo petroleum products totaling KRW 322,99,70,790,790 from July 1, 2014 to August 5, 2014, which was operated by customers F, who had paid 85% of light oil to the oil station of G 14 tons truck, by inserting it into the oil station of G 14 tons, and sold to customers without their names the sum of pseudo petroleum products totaling KRW 519,70,790,790 from July 1, 2014 to August 5, 2014.

2. The Defendant, in collusion with the above C on August 5, 2014, sold a total of 322,994.965 liters to the victims under his name in collusion with the above E oil station at around 22:00, and sold pseudo petroleum mixed with 85% oil, including light oil, to the victims as if they were oil oil transit and sold G 14 tons of freight truck to the oil station operated by the victims, and received KRW 547,000 from July 1, 2014 to August 5, 2014, and received KRW 519,70,790,790 from the victims.
