1. The Defendant shall pay to the Plaintiff KRW 38,295,366 and the interest rate of KRW 20% per annum from March 16, 2017 to the day of complete payment.

In addition to the statement in Gap evidence No. 1, the plaintiff provided labor to the defendant from March 4, 2009 to March 1, 2017. ② The defendant did not pay the defendant the remaining 38,295,366 won (=4,572,483 won - 6,27,117 won, excluding the amount of interim retirement allowance of KRW 44,572,483 in total, including wages, retirement allowances, and unused annual allowances, from November 4, 2016 to February 1, 2017.

Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 20% per annum from March 16, 2017 to the day of full payment, which is the 38,295,366 won, including unpaid wages, etc., and from March 16, 2017, to the day of full payment.

Thus, the plaintiff's claim of this case is accepted.
