The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. There is no fact that the Defendant committed indecent act by compulsion of the victim as stated in the lower judgment.

B. Whether a person constitutes an indecent act by misapprehending the legal doctrine ought to be determined with careful consideration of the victim’s intent, gender, age, relationship between the perpetrator and the victim prior to the act, circumstances leading to the act, specific form of act, and the objective situation surrounding the act, and the sexual moral sense of the age.

Therefore, even if there was a physical contact between the Defendant and the victim in the course of conducting experiments, it is difficult to view such act as an indecent act by compulsion. Therefore, the lower court erred by misapprehending the legal doctrine on indecent act, thereby affecting the conclusion of the judgment.

2. 판 단 원심이 적법하게 채택하여 조사한 증거에 의하여 인정되는 다음과 같은 사정, 즉 ① 피해자는 수사기관 이래 원심 법정에 이르기까지, 피고인과 피해자가 수업 시간에 한 조가 되어 실험을 하게 되었고 피해자가 주도적으로 실험을 하고 있는데, 피고인이 피해자의 뒤에 다가와 피고인의 성기를 피해자의 엉덩이에 대고 비볐다는 취지로 구체적이고 일관되게 진술한 점, ② 피해자는 이 사건 범행 이전에도 피고인이 유사한 행동을 반복하는 것 같다고 생각했고, 그리하여 이 사건 당일 다른 학생들에게 피해자가 실험을 하는 동안 피고인의 행동을 지켜봐 달라고 요청하기도 한 점, ③ 피해자가 같은 과 학생이었던 피고인을 모해할 의도로 허위 사실을 고소하였다고 볼 만한 사정을 찾아보기 어려운 점, ④ F, G, H이 수사기관 및 원심 법정에서 한 진술에 의하면 피고인은 실험 도중에 피해자의 엉덩이 뒤쪽 가까이에 서 있었던 것으로 보이는 점 등을 종합하여 보면, 피고인이 공소사실 기재와 같이 피고인의 성기를 피해자의 엉덩이에 대고 수회...
