Reasons
1. Facts of recognition;
가. 원고와 피고는 2008. 4월경 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㄱ의 각 점을 차례로 연결한 선내 부분 별지 목록 제1항 기재 토지와 ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅁ의 각 점을 차례로 연결한 선내 부분 168㎡ 및 A, B, C, D, A의 각 점을 차례로 연결한 선내 부분 80㎡ 각 지상 별지 목록 제2항 기재 건물(이하 토지와 건물을 통틀어 ‘이 사건 부동산’이라 한다)에 관하여 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였고, 이 사건 임대차계약이 묵시적으로 갱신되어 오다가 2012. 4. 30. 임대차기간 2012. 5. 1.부터 2013. 4. 30.까지로 정한 새로운 임대차계약서를 작성하였으며, 2013. 4. 30. 이후부터 이 사건 임대차계약이 묵시적으로 갱신되어 왔다.
B. The rent under the instant lease agreement is KRW 1,320,00 per month from April 2008 to March 2010, KRW 1,540,00 per month from April 2010 to March 2014, KRW 1,60,00 per month from April 2014, and KRW 22,601,450 per month from April 30, 2018.
C. The Plaintiff is seeking delivery, etc. of the instant real estate while notifying the termination of the instant lease agreement by serving a duplicate of the complaint of this case.

2. According to the facts of the above recognition, the instant lease was lawfully terminated upon the Plaintiff’s declaration of termination on the ground of the Defendant’s non-performance of obligation to pay rent.
Therefore, the defendant is obligated to deliver the real estate of this case to the plaintiff and pay the plaintiff the rent of 22,601,450 won and the amount of unjust enrichment equivalent to the rent of 1,60,000 won per month from May 1, 2018 to the completion date of delivery of the real estate of this case.
For this, the defendant is liable to pay to the plaintiff by the end of 2016 and the rent of KRW 2,800,000.
