Defendant shall be punished by a fine of two million won.

If the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

On September 14, 2017, the Defendant committed an indecent act against the victim by coercioning the victim’s knife on about four occasions by reporting the victim F (V, 26 years of age) in front of the Defendant at E Station located in Daegu-gu, Daegu-gu, about 19:00 to the exit of 13 times.

위 인정사실에 다가 피해자는 수사기관 및 법정에서 일관되게 당시 어떤 물건이 피해자의 엉덩이에 닿는 느낌이 아니라 손가락 같은 것으로 꾹 찌르는 느낌이었다고 진술한 점, 에스컬레이터에서 바로 앞에 이성이 서 있다면 통상은 신체에 닿지 않도록 조심하게 되는데, 피해자가 찌른다고 느낄 정도의 접촉이 있었고 그것이 반복되었으며, 특히 접촉된 부위가 여성의 엉덩이 부위라면 행위를 하는 당사자 입장에서도 비록 무의식 중에 손가락을 튕기는 습관이 있다고
