[2013 High Court Decision 890]
1. On August 31, 2010, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (hereinafter “Special Cases Concerning the Settlement of Traffic Accidents”), driving a B-type vehicle without a car driver’s license, and parked the vehicle in the NAE parking lot in the Seocho-gu Seoul Metropolitan City.
In such cases, a person engaged in driving of a motor vehicle has a duty of care to check the vehicle operation system, etc. and prevent accidents in advance.
Nevertheless, the defendant neglected to take measures to operate the vehicle system accurately, and led the victim C (Nam, 51) who was parked in front of the defendant's driver's vehicle to the front part of the driver's vehicle.
The Defendant suffered approximately two weeks of medical treatment due to occupational negligence from the victim’s left-hand fluoral in need of medical treatment.
2.
