A defendant shall be punished by imprisonment for not less than eight months.

The defendant pays 75,530,000 won to the applicant through fraud.

Punishment of the crime

[2018 Highest 1634] On January 9, 2018, the Defendant posted a letter stating that “I will sell KRW 9,100,000 in cash as gift certificates to KRW 91,00,000,” in the NAB, the Defendant, “I will sell gift certificates to KRW 10,000,000 if you deposit KRW 9,10,000.”

However, as at the time of individual rehabilitation, the Defendant was liable for approximately KRW 45,00,000,000 in terms of personal rehabilitation, it was thought that he would receive money from the injured party for the purchase of merchandise coupons, and even if he did not intend to purchase merchandise coupons with the welfare points of the fire officers, he did not have the intent or ability to deliver merchandise coupons to the injured party.

As above, the Defendant: (a) by deceiving the victim; and (b) obtained a total of KRW 75,530,000 from 15 times to 15 times as indicated in the List of Crimes 1 through 5, 2018 from January 16, 2018 to February 5, 2018 from the victim; and (c) obtained the remittance from the victim to the national bank account (C) and the new bank account (D).

[2018 Highest 2028] On July 2017, the Defendant, at the Defendant’s home located in Dongducheon-si, prepared and posted a letter of “sale of gold gift certificates” on the NAV in the Korean car page, using smartphones, and made a false statement that the Defendant sold the said gift certificates to the victim F who reported and contacted the above letter.

However, the defendant did not have the intention or ability to deliver merchandise coupons even if he receives the sales payment from the injured party.

The Defendant received KRW 620,00 from the injured party on July 22, 2017.

In addition, the Defendant received a total of KRW 4.79,00,00 from around that time to November 14, 2017 as shown in the list of crimes in attached Table 2.
