A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant is an applicant for compensation of KRW 14.2 million and the defendant is an applicant for compensation.

Punishment of the crime

[Criminal Power] On July 14, 2016, the Defendant was sentenced to six months of imprisonment for fraud at the Busan District Court, and completed the execution of the sentence on November 7, 2016.

【Criminal Facts】

The Defendant became aware of the victim B through the Internet real estate investment car page in 2018.

1. On May 24, 2017, the Defendant stated, “On the other hand, the Defendant would be entitled to KRW 45 million for the victim’s vehicle with the damaged e-mail car, which is located in the Nam-gu office roof-dong, Ulsan-gu, Ulsan-gu, Seoul-do, and could not sell the vehicle after repair.” The Defendant stated, “The Defendant would have invested KRW 25 million in money necessary for the purchase and repair of the vehicle.”

However, the defendant did not know about damaged bents and expressed his intent to use money for personal use after receiving the money from the victim.

As above, the Defendant, by deceiving the victim as above, received 25 million won from the victim on the same day.

2. On July 5, 2017, the Defendant made a false statement that “The Defendant may purchase the damaged A3 and A6 car at 10 million won by telephone, and even if sold after repair, profits would be fine. As the purchase cost of the vehicle falls short of 6,500,000 won, the Defendant would be equal to half of the principal and remaining profits as if the vehicle was traded as before the investment sea.”

However, the Defendant did not know about the damaged friendly passenger car like the preceding paragraph, and was willing to receive money from the victim and use it for personal use.

As above, the Defendant, by deceiving the victim, received 6,50,000 won from the victim and acquired it by fraud.
