A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

1. 특수협박 피고인은 B(여, 51세)와 교제하는 사이로, 주점을 운영하는 B가 평소 주점 손님들과 어울린다는 이유로 말다툼을 하는 등 관계가 원만하지 않던 중 2019. 4. 27. 21:00경 목포시 C에 있는 ‘D’ 주점에서, B가 손님인 피해자 E 등과 함께 술을 마시고 있는 모습을 보고 화가 나 피고인의 차량에 있던 위험한 물건인 회칼(칼날길이 약 20cm)을 갖고 와 피해자 E에게 겨누면서 “호프집에 너무 자주 온다, 오지마 새끼야, 죽여버린다“고 말하여 피해자를 협박하고, 계속하여 E의 일행인 피해자 F가 이를 만류하자 피해자 F의 목에 회칼을 들이 댄 채 찌르는 시늉을 하면서 ”일행은 비켜라”고 말하여 피해자를 협박하고, 이에 또 다른 일행인 피해자 G가 이를 만류하자 피해자 G의 가슴과 얼굴 부위에 회칼을 가까이 겨누고 찌르는 시늉을 하면서 “너도 저놈들이랑 일행이냐”며 말하여 피해자 G를 협박하였다.
