A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. "2019 Highest 983";
A. On January 11, 2019, the Defendant, at the office located in Pakistan-si B, posted a false statement on goods soliciting three-day straw travel to Internet C, using a computer, and sent a false statement to the victim E, who reported and contacted, four straw travel.
However, in fact, the defendant used the money received from the victim for the cost of living, or did not have the intent or ability to send the victim with the full travel.
The Defendant received 1,845,000 won from the victim to the corporate bank account (F) in the name of the Defendant for the same day as the travel price.
B. On January 15, 2019, the Defendant, at the foregoing office, posted a letter of goods soliciting four-day straw travel as above, and made a false statement to the victim G who reported and contacted the said letter of goods, and sent the said travel to the victim G.
However, for the foregoing reasons, the Defendant did not have any intention or ability to send the victim with the arm's length travel.
The Defendant received 738,00 won from the victim to the above corporate bank account on the same day.
Accordingly, the Defendant deceiving two victims as above, and received a total of KRW 2,583,00, respectively.
2. On July 14, 2018, the Defendant: (a) posted “D” at a non-place around 16:00 on July 14, 2018; and (b) posted by the Defendant to “D” on the Internet, KRW 5 days after the Daegu start of 28. Daegu; (c) Dag-ho; (d) 5 days after the date; (e) 599,000 travel goods; and (b) at the victim H who contacted through the Kakakao Stockholm, the price is KRW 69,00,00, including the fuel surcharge for the said travel goods; and (c) if the following price is more than the price, the Defendant immediately wired the amount.
The reservation will be made immediately as the price is remitted.
The purpose was to make a false statement to the effect that "...."
However, the defendant is an individual even if he receives the payment from the victim at the time of transfer.
