A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

"2019 Highest 1992"

1. On February 3, 2019, the Defendant posted a false statement on “pop-up shop for cultural merchandise tickets” by accessing the Busan-gu D apartment, Busan-gu, and FF carpet G, and then sent the victim H with “129,000 won as to remittance of KRW 129,000,000 to the victim H.”

However, in fact, the Defendant did not have the above merchandise coupon number and did not have any intention or ability to send the said merchandise coupon number even if he received money from the victim.

The Defendant, by deceiving the victim as such, received KRW 129,00 from the victim’s account in the name of the Defendant on the same day.

2. On February 2, 2019, the Defendant posted a letter “pop-up shop” by accessing FKaf G at the place indicated in the foregoing paragraph 1., and falsely read the victim K who visited the Defendant as “pop-up shop will send money first if he transfers money.”

However, as the defendant did not have the above merchandise coupon, he did not have an intention or ability to send money even if he received money from the victim.

On February 15, 2019, the Defendant, by deceiving the victim, received 44,000 won from the victim’s account in the name of the Defendant (J).

On December 2, 2018, the Defendant, “2019 Highest 2409,” made a false statement on the Internet “L” bulletin board to the effect that the Defendant would send the Google card if he/she transfers money to the victim M& (ma, 22 years of age) who reported and contacted with the Internet.

However, even if the defendant receives money from the victim, he did not have the intention or ability to send the Google Card.

Nevertheless, around December 2, 2018, the Defendant, by deceiving the victim as above, received 80,000 won from the victim to the N bank account in A’s name.
