1. The Defendant’s KRW 17,645,864 as well as the Plaintiff’s KRW 5% per annum from September 11, 2015 to November 13, 2015.
Reasons
1. 손해배상책임의 발생 갑제1내지 6호증의 각 기재에 변론 전체의 취지를 종합하면, 피고는 2014. 7. 29. 23:20경 원고와 시비가 일어 다투던 중 원고의 얼굴을 주먹으로 수회 때리고 발로 수회 걷어찼고, 이에 원고는 전치 2주의 치아아탈구, 하악좌두측중절치, 전치 56일의 좌측 안와 하벽골절 등의 상해를 입은 사실이 인정된다.
According to the above facts of recognition, the defendant is responsible for compensating the plaintiff for damages caused by the above illegal acts.
2. In light of the above evidence, the scope of liability for damages is examined as to the Plaintiff’s damages.
Medical expenses: 4,093,018 won for internal surgery, 1,078,760 won for internal medicine and medical expenses, 681,160 won for internal medicine and rehabilitation surgery, dental expenses, 16,260 won for additional dental treatment expenses, 910,000 won for dental treatment in the future (excluding losses incurred in the event of periodic replacement in the future), and 50,000 won for issuance of a medical certificate for oral surgery, 50,000 won for preservation and written diagnosis, 10,000 won for issuance of internal medicine and written diagnosis, and 6,979,198 won for internal medicine and medical expenses: The Plaintiff seek reimbursement of KRW 1,200,000 for damages incurred by an unpaid disease.
1) Since it is recognized that the Plaintiff was hospitalized from August 3, 2014 to August 8, 2014 for the treatment of gymnasium, income during the pertinent period constitutes damage. The Plaintiff’s average of KRW 3,100,000 for July 7, 2014, and KRW 2,500,000 for September’s salary, which the Plaintiff received medical treatment due to the instant case, can be deemed as the monthly average wage. Therefore, the daily income during the pertinent period is deemed as KRW 66,666 (=2,80,000) 】 666,666 days (the number of ordinary days during the pertinent period of hospitalization) / 21 (the number of ordinary days during the foregoing period of eight months) / 21 (the number of ordinary days during the foregoing period of eight months) / 21 (the number of ordinary days in August), but it appears that it was necessary for 2014, May 16, 2014.
