Reasons
Punishment of the crime
1. The Defendants’ co-principal
A. As if the Defendants were to open a mobile phone normally by stealing another person’s name, the Defendants conspired to receive a mobile phone device from the mobile phone supplier and sell the mobile phone device and the core card separately to the “largephone” solicitation book by distinguishing them.
On February 27, 2013, the Defendants, without authority, forged a new service contract, a contract to install a device, a contract to sell a mobile phone, the name of the customer of the application for subscription to the contract to enter into the contract, the “J” in the resident registration number column, and the “J” in the address column, and the “J” in the “J” without authority, with the intention of exercising another person’s personal identification card and account number obtained from the non-resident of his/her name at the mobile phone agency located in the Dong-gu Busan Metropolitan City, Busan, and forged a new service contract, which is a private document on the rights and duties of the applicant for subscription under the J’s name, one copy of the franchise contract, one copy of the terminal, and one copy of the contract to enter the contract discount system, respectively.
The Defendants continued to use a forged new service contract in the name of J, one copy of the franchise contract, one copy of the franchise contract, and one copy of the application for subscription to the contract discount system, as if they were actually prepared, and by facsimile transmission to the SK Telecom staff who is not aware of the fact.
In addition, the Defendants conspired to commit the following acts: (a) between February 27, 2013 and March 20, 2013, as indicated in the attached list of crimes list (1), each forged a new service contract, which is a private document concerning rights and obligations, and an application for subscription to a sales contract or a contract discount system, which is a private document, for the rights and obligations, and used 49 times.
B. In fact, the Defendants, by stealing another person’s name, opened a cell phone as if they were in normal openings, and opened a cell phone, and then opened a cell phone and a core card.
