Details of the disposition

The Plaintiff is the professor of B University, from April 2009 to February 2013, and was the director of C Research Institute, a research facility attached to the above school.

(hereinafter “instant university” or “instant research institute”). The Defendant, through the Korean Research Foundation, implemented a support project for university priority research institutes supporting research tasks and academic performance of universities affiliated research institutes.

(hereinafter referred to as “Defendant” without distinguishing the Defendant and the Korea Research Foundation, except where there is a need to distinguish them. A research institute of this case applied for academic research support to Defendant and selected the Plaintiff at the time of January 2010 as a person in charge of research [the total research period is nine years (from September 1, 2010 to August 31, 2019) and three years, respectively. In this case, only one of them is the first phase (from September 1, 2010 to August 31, 2013; hereinafter referred to as “instant subject”).

Accordingly, the president of the Korea Research Foundation, the president of the Korea Research Foundation, and the head of the instant university in charge of actual research of the said university need to be the subject of legal personality in the research institute of this case and the support of research funds, etc., and it seems that the instant university, instead of the instant research institute,

Unless it is necessary to distinguish below, the term “university of this case” is generally referred to as “university of this case.”

The head of the Gu, the Plaintiff, and the Joint Research Institute concluded the “Agreement on the Selection of New Research Institutes Support Projects for Universities and Colleges in 2010” [see Article 19 of the former Regulations on the Management of Research and Support Projects for Cultural and Social Sciences (wholly amended by Ministry of Education Directive No. 26, Nov. 4, 2013; hereinafter referred to as the “Agreement”).

The main contents of the above Directive and the instant Convention are as shown in the attached Form.

Many of the subjects of this case, including nine professors, five former researchers, and thirty research assistants, including the Plaintiff who is a person in charge of research.
