A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2012 Highest 4829] On April 10, 1995, the Defendant entered into a check contract with the Hancheon-ro branch of the Japanese Bank and the Defendant, and issued the provisional coefficient check.

On May 20, 2002, the Defendant borrowed five million won from a person who was unaware of his name at the “F office” office operated by the Defendant in Seongbuk-gu Seoul, Seongbuk-gu, and issued one copy of the check number “G”, “5 million won”, “200,000 won”, and “A” as a collateral, and delivered one copy of the household check to the person who was unaware of his name.

On October 3, 2003, the defendant, at the office of the defendant on October 1, 2003, was extended the due date for the borrowed money from the above person in default of his name, and the date of payment of the check was corrected on February 3, 2004.

On January 30, 2004, when the check holder was at the time of payment, the check holder, the check holder, presented the check at the Yeongdeungpo-gu Seoul Metropolitan Government Yeongdeungpo-dong 5-11, the check payment at the Yeongdeungpo-dong 25-11, but did not pay the above money due to the suspension of transaction.

Between April 2003 and May 2003, the Defendant issued a check number H, face value of KRW 5,000,000, and date of issuance on October 27, 2003 at the F office located in Seongbuk-gu Seoul, Seongbuk-gu, Seoul.

On October 27, 2003, the Defendant had not paid the shortage of deposit even though the check was presented to the above bank on October 27, 2003.

The Defendant, including this, issued a total of 48,50,000 won in the same method over 10 times, as shown in the attached list of crimes, at the above F Office around that time.
