Punishment of the crime

On January 30, 2012, the Defendant sent e-mail to the victim’s e-mail account containing the content of “to live as a woman of crather,” etc. on seven occasions with the victim’s knowledge of working together with the victim C and the Ministry of Government Legislation, etc., and had the victim feel fear or apprehensions by doing so from around that time to May 2013, 2013, including 306 times in total, 1,460 times in text messages, and 397 times in telephone calls.

Accordingly, on October 31, 2013, the Defendant was sentenced to two years of suspension of execution on June 13, 2014 by imprisonment with labor for violating the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. at the Seoul Central District Court.

1. Violation of Information and Communications Network Utilization Promotion Act;

(a) No one shall allow any person to repeatedly reach the other party with a sound inducing fear or apprehension through an information and communications network;

Nevertheless, at around 11:13 on December 11, 2013, the Defendant made a phone call with a victim C’s Handphone using a public telephone, and followed the sound that arouses fear or apprehension through an information and communications network repeatedly by repeatedly making a phone call to the victim four times from around that time to July 24, 2014, as indicated in the attached Table No. 1 to No. 4, from around July 24, 2014.

(b) No one shall repeatedly allow any person to reach the other party with a sound inducing fear or apprehension through an information and communications network;

Nevertheless, at around 23:09 on July 7, 2014, the Defendant called “Along with a victim’s Handphone using a public telephone in front of Jongno-gu Seoul Metropolitan D Building,” and then “Along with the time, I want to talk in the city, I want to do so, and I do not want to do so.”
