A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is the victim C (V, 51 years of age) who is the wife of the victim B (56 years of age) and the Defendant was in an internal relationship between the end of 2012 and the end of 2013.

1. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall allow anyone to repeatedly reach another person any code, text, sound, image, or picture that arouses fear or apprehension through an information and communications network;

A. Nevertheless, the Defendant, on December 21, 2013, committed the crime against the victim B, using his/her mobile phone (D) at a non-permanent place around 02:41, 201, on the ground that the Defendant: (a) sent a voice message from the mobile phone (E) used by the victim B, which he/she became aware of, on the ground that he/she does not do so; (b) sent the victim B with the victim’s cell phone (E), and sent the victim’s voice wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom wom h, and (c) sent the victim’s fear or apprehension through a total of 37 instances from around February 15, 2014 to February 58, 2014.

B. The Defendant committed the crime against the victim B, on December 23, 2013, using his/her cell phone (D) at an irregular place around 00:36, 2013, on the ground that the said C does not have to meet himself/herself, sent the voice message of C’s cellular phone (F) used by his/her father, who was known to him/her, to the previous by means of his/her mobile phone (D).
