1. As to the Plaintiff’s KRW 361,606,230 and KRW 242,188,306 among them, the Defendant shall start on May 31, 2015, and the remainder 119,417.
Reasons
1. Facts of recognition;
A. On April 3, 2009, the Plaintiff entered into a provisional contract with 915,537,425 won (hereinafter “the instant shopping district”) of the B1st floor of Yongsan-gu Seoul, Yongsan-gu, Seoul, to sell (hereinafter “the instant provisional contract”) on April 6, 2009 each payment made on April 6, 2009, 915,537,425 won (hereinafter “the instant provisional contract”) and 5,00,000,000 won for provisional contract, April 3, 2009, 194,514,937 won for down payment, 9,514,937 won and each payment made on May 6, 2009.
B. After that, on April 9, 2009, the Plaintiff (Buyer) drafted a real estate sales contract again with the Defendant (seller) selling the commercial building of this case on April 9, 2009, on each of the payment dates of KRW 796,119,50 in total, KRW 39,805,975, April 9, 2009; KRW 29,223,90 in part payments; KRW 159,223,90 in part payments; KRW 159,23,23,90 in part payments; KRW 159,23,23,90 in part payments; KRW 398,059,750 in remainder payments; and KRW 398,059,750 in each of the payment dates of the contract issued by members.
(hereinafter referred to as the “instant sales contract”). On the other hand, Lenenenen confirmed that “I will confirm that I will use business promotion expenses and marketing/ consulting/advertisement/personnel/personnel management, etc. in concluding a sales contract for a group of union members of a D urban environmental improvement project in the first 59,708,963 won, the second 59,708,963 won,” and “I will confirm that I will use them for the first 59,708,963 won.”
C) The Plaintiff issued the instant provisional contract to the Plaintiff. Pursuant to the instant provisional contract and the instant sales contract, etc., the Plaintiff paid the ASEAN and the Defendant KRW 361,60,356 on April 3, 2009, KRW 5,000, KRW 94,514,937 on April 6, 2009, KRW 40,000 on May 15, 2009, KRW 59,514,937 on May 20, 2009, KRW 59,514,937 on May 23, 2009, KRW 23,90 on November 159, 23, 200, KRW 3,352,456 on November 23, 200, respectively.
After that, as the progress of the above business is delayed due to the change of the design, the deadline for the second and the remainder payment has been indefinitely extended.
The above project has been delayed.
