1. The plaintiff's primary claim against the defendants is dismissed in entirety.
2. Defendant C’s KRW 42,879,492 and its amount.
Reasons
1. The following facts may be found either in dispute between the parties or in combination with the whole purport of the arguments as to Gap evidence 1-6, Eul evidence 1-4, Eul evidence 1-2, Eul evidence 1-9-2, and Eul evidence 1-2, witness D, E, and F's each testimony and statement of fact-finding in light of the whole purport of the arguments.
G as the owner of the 196.56 square meters of the Ga Dong-dong factory, B-dong 112.77 square meters of the B-dong factory, C-dong factory, 196.56 square meters of the D-dong factory, and 196 square meters of the 196.56 square meters of the D-dong factory (hereinafter each “A-dong,” “B-dong,” “C-dong,” and “D-dong,” collectively referred to as the “instant building”), G leased Dong to Defendant A operating “I,” Defendant B operating “J,” and Defendant C operating “K,” respectively, on April 30, 2012, the respective lease agreements were renewed between the Defendants.
Since December 31, 2007 to December 31, 2012, G entered into a contract between the Plaintiff with the insured as to the instant building with G, and with the insurance coverage period of KRW 73,00,000 for Dong, KRW 42,00,000 for Dong, KRW 73,00,000 for Dong, and KRW 72,00,000 for Dong, and KRW 72,000 for D Dong.
However, around 07:41 on May 25, 2012, a fire (hereinafter “the instant fire”) occurred and the instant building was removed. The Plaintiff paid G 15,00,000 won for each of the instant building on June 27, 2012 according to the said insurance contract, and paid 24,780,377 won for A Dong on August 17, 2012 (total 39,780,377 won), and 7,369,987 won for B (total 22,269,987 won), and 20,736,536 won for Cdong (total 35,736,536 won), and 20,7829,29,285 won for Ddong (total 39,780,377 won), and additional payment was made for D 20,785 won (total 29,285 won).
