피고인은 2019. 12.경 성명불상의 보이스피싱 조직원으로부터 위챗 메신저를 통해 ‘상품권을 받아서 현금화 시켜 지정된 계좌로 송금해주면 하루에 최저 60만 원의 수익을 보장해주겠다’는 취지의 제안을 받고 그것이 정상적인 자금거래방식이 아니라서 보이스피싱 범행과 관련될 수 있다는 사실을 인식하고서도 이를 승낙하여, 위 성명불상자의 지시에 따라 위 성명불상자가 지정하는 일시, 장소에서 상품권을 수령한 뒤 이를 현금화하여 위 성명불상자가 지정하는 계좌로 송금하는 역할을 수행하기로 위 성명불상자와 공모하였다.
